The other day I was driving, it was about 3:30 in the morning and I came to a stop sign. I slowed down; applying my breaks made a quick stop and proceeded. A little bit down the road I see flashing lights behind me, of Corse it?s a cop. So I pull over, about 10 minutes later he finally got out of his car and walked over to mine. He asks, "Do you know why I pulled you over?" I reply no, because I don?t know what he is pulling me over for and I don?t want to guess and self incriminate me. So he tells me that I ran that stop sign back there. I reply, "What?" He tells me that I blew through that stop sign. I explain to him that I in fact did not run that stop sign, that I did in fact apply my braks. I tell him that, yes I did not make a full 3 second stop, but I did not blow through it. He gives me a ticket and tells me I can fight it in court. I figure going to court would waste of my time, seeing how there is no way to prove it, that it would be a case of he said she said.
I don't consider this running a stop sign, just for the main fact that my brakes were being applied. That I did stop, just not for a full 3 seconds. I feel that in order to be considered running a stop sign, you drive right through it without any intention of stopping or slowing down.
So I'm curious as to how you all fell about this. Is that considered running the stop sign? What do you consider running a stop sign?
Also if I did take this to court how could I fight my case?
